Protection of trees on construction sites. Trees are often damaged at construction sites. There are several recipes, which should - while respecting them - prevent damage to trees on construction sites.

Act of 31.1.1961 r. (Construction law) Dz. U. no 7/61 item. 16 art. 46 p. 3 proclaims m. in “that existing trees and shrubs on the construction site, if they are not intended for liquidation, should be properly secured during construction works. The minimum required distances of trees and shrubs from buildings and network devices are specified in Regulation no 5 Minister of Municipal Economy. Dz. Bud. No 8/65 of 4 February 1965 r. on the establishment of a technical standard for streets and city squares:

The above-mentioned distances apply to trees with a crown not larger than 4 m in diameter.

This regulation is in a paragraph 3.3.2. imposes a supplementary measurement of the altitude of the planned street along with the terrain elevations of the existing valuable tree stand. The same law is fixed, that in the event that the surface is tiled, planting in open bowls of 1.5 cm×1,5 m. Regulation of the Minister of Local Economy and Environmental Protection Dz. U. No 4/73 item. 29 of 20.1.1973 r. concerns, among others. determining the places of implementation of construction investments and state construction supervision over general construction. In addition, regulations on the protection of trees are established locally in individual cities, e.g.. in Warsaw, the Regulation of the Presidium of the National Council of the. st. Warsaw. Dz. Journal no 6 item. 45 of 13 March on the protection of greenery in the area of. st. Warsaw. Among other things, in this area it is forbidden to destroy public green space in any way, as well as to cut down and destroy trees in any way, regardless of, whose property they belong to (§ 1).

In case of, when the area occupied by public greenery must be related to construction works, demolition and investment projects, temporarily used, the person conducting these works is obliged to ensure, that the stand is properly protected against deterioration or damage. After completion of the works, the greenery should be restored by construction companies conducting the works - at their expense - to a proper condition, in particular, the terrain should be leveled, lawns dug and sown, and any possible damage to the stand was repaired (§ 2).

If necessary, cut trees, even partially withered, The land user should obtain a permit from the relevant municipal department. This department qualifies the tree for removal in consultation with a representative of the League for Nature Conservation (§ 3).

Due to its rarity, 5 tree species, namely yew, language, paternal birch, wild service tree and swedish mountain ash, is covered by species protection throughout the country on the basis of the Regulation of the Minister of Forestry and Wood Industry of 28 February 1957 r. on the introduction of species protection of plants (Dz. U. no 15, item. 78). It can be stated, that there are enough laws, to protect trees. However, its full effectiveness can be ensured by conscious compliance with the regulations and consistent enforcement by factors responsible for the state of vegetation.
